Property Ownership Policy
Governing ownership declarations made on the Recal platform

This policy applies to all users who declare ownership of, or authorised representation for, a property listed on the Recal platform. By making such a declaration you confirm that you have read, understood, and agree to the terms below.
1. What the Ownership Declaration Means
When you select “I am the legal owner of this property” during property setup, you make a legally binding declaration that one of the following is true:
- You are the registered legal owner of the property in question; or
- You have received express, verifiable authorisation from the legal owner to act on their behalf in the capacity of managing, listing, and administering the property on the Recal platform.
This declaration is timestamped and recorded against your account for audit and compliance purposes.
2. Your Responsibilities
By making this declaration you agree that:
- All information you provide about the property is accurate, complete, and not misleading.
- You will maintain valid ownership or authorisation for the duration of the property’s listing on Recal.
- You will promptly notify Recal if your ownership status or authorisation changes.
- You accept full responsibility for any content, bookings, or transactions associated with the property listing.
3. Consequences of Misrepresentation
If Recal determines, at its sole discretion, that an ownership declaration is false, fraudulent, or no longer valid, we reserve the right to take any or all of the following actions without prior notice:
- Immediate removal of the property listing.
- Suspension or permanent termination of your Recal account.
- Disclosure of your account information and declaration records to the legitimate property owner and/or their legal representatives.
- Cooperation with law enforcement or regulatory authorities where required.
Additionally, the legitimate property owner may pursue independent legal action against you. Recal may provide timestamped declaration records and associated account data to support such proceedings.
4. Reporting Unauthorised Listings
If you believe that a property has been listed on Recal without the legitimate owner’s consent, you may report it by contacting us at support@recal.co.
When reporting, please include:
- The property address or listing URL.
- Evidence of your ownership or legal interest in the property (e.g. title deed, land registry extract, or power of attorney).
- Your contact details for follow-up.
Recal will investigate all reports promptly. During an active investigation we may suspend the listing and restrict the associated account’s access to owner features pending resolution.
5. Dispute Resolution
Where an ownership dispute arises between two or more parties, Recal is not an arbitrator and does not determine legal ownership. Our role is limited to:
- Suspending the disputed listing until the matter is resolved externally.
- Providing declaration records and timestamps to the parties involved or to competent authorities upon lawful request.
Recal encourages parties to resolve disputes through appropriate legal channels.
6. Changes to This Policy
Recal may update this policy from time to time. Material changes will be communicated via the platform. Continued use of owner features after a policy update constitutes acceptance of the revised terms.
7. Governing Law
This policy is governed by and construed in accordance with the laws of Spain. Any disputes arising from or in connection with this policy shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence.
